“An Ounce Of Mediation is Worth A Pound Of Arbitration And A Ton Of Litigation”

know your rights

When you’re involved in a dispute, there are a few things to keep in mind.

First, know your rights and responsibilities in the matter. If you’re not sure what your rights are, or how to manage them, go to an attorney who specializes in dispute resolution.

Secondly, if you wish to seek arbitration, be sure that the employer agrees. The corporation may have its own dispute resolution mechanism that it wants you to follow, or it may not be interested at all in arbitration. Check with your employee handbook for additional information about this procedure—and if you find out that the firm wants you to utilize arbitration instead of their internal process, don’t allow yourself be coerced into going along with it!

Finally, know how long mediation lasts for. If your disagreement is small enough and short enough (less than 6 months), mediation is typically the best choice for both sides because it doesn’t demand much time or money from either side and may frequently result in an agreement between the parties before litigation begins.
